NY mom fails drug test after eating poppyseed bagel before giving birth
TOWN OF TONAWANDA, N.Y. (WKBW) — Less than a week after baby Carter Dominguez was brought into the world, baby and mom are enjoying time at their home in the Town of Tonawanda.
But this arrival wasn’t easy.
“I just want everyone to know that this can happen,” she said. “I don’t want it to happen to anyone else.”
When Elizabeth went into labor, she was asked for a urine sample.
“I did a urine test and it came back that I tested positive for opiates,” she said. “I called my husband freaking out saying ‘how is this possible?’ I don’t do drugs,” she said.
Her husband Mark asked what she had to eat that day.
“And I told him a bagel and a sub. That’s all I had. He told me it must be from the bagel.”
Elizabeth had eaten a bagel, covered in poppyseeds. Poppyseeds are derived from the opium plant.
“In some cases eating a large amount of poppyseed such as the kind found in a bagel has been shown to produce low levels of morphine and codeine in the urine,” said Dr. Michelle Rainka, a Clinical Pharmacist at DENT. “Potentially those seeds have not been washed and can contain that.”
Dr. Rainka says anyone about to take a drug test should know this.
“Anywhere from one to three bagels with poppyseeds can produce positive tests on a urine toxicology.”
Dominguez gave birth later that day, and her baby’s tests for opiates came back negative. Still, the hospital monitored Carter for withdrawal, and because of Elizabeth’s failed drug test, hospital staff followed protocol and called Child Protective Services.
Elizabeth was discharged but Carter had to stay, separating mom and baby less than 24 hours after birth.
“I felt absolutely horrible,” she said. “I felt like a terrible mother leaving him. I just want everyone to know that this could happen. It’s such a terrible thing and I don’t want it to happen to anyone.”
Reports show Elizabeth did have a false positive because of the poppyseed bagel.

Man demands sex act after stealing sleeping woman’s phone on subway
LOWER MANHATTAN — Authorities are looking for man they say stole a woman’s cell phone on the subway and then demanded a sexual act in exchange for her phone back.
After the 21-year-old victim fell asleep aboard a northbound R train near the Whitehall Street subway station on Sunday, May 12, around 11:30 p.m., an unidentified man stole her cell phone and then woke her up, demanding a sex act in exchange for the return of the phone, police said.
Authorities said a struggle ensued between the man and woman after he attempted to steal additional property from her.
When he was unsuccessful, he fled the train at Canal Street subway station with the victim’s phone, police said.
EMS responded and transported the victim to an area hospital, according to police.
Authorities said the man wanted for questioning is described as in his mid 20s, standing about 5 feet, 10 inches tall, and weighing about 180 pounds. He was last seen wearing all dark clothing, and can be seen in the above surveillance footage released by police.

68-year-old woman in coma sexually assaulted at Bronx hospital
MOTT HAVEN, the Bronx — A man is sought after walking into a Bronx hospital and sexually assaulting a woman in a coma Monday afternoon, according to police.
Authorities said the unidentified man slipped into the 68-year-old victim’s hospital room and sexually abused her on Monday around 3 p.m. at Lincoln Medical Center in the Mott Haven section of the Bronx.
A police source told PIX11 the man entered the lobby of the hospital, took the elevator up and walked into the victim’s hospital room, which she shared with another female patient.
The conscious patient in the room said she witnessed the man on top of the unconscious victim, performing a sex act on her. She then called the nurse, who also saw what was happening and managed to scare him off, according to the police source.
The man left the hospital before security guards could catch him, authorities said.
Police sources said the victim has been in a coma since being admitted to the hospital on April 21.
Authorities describe the man wanted for questioning as about 55 years old, standing about 5 feet, 7 inches tall, with a thin build, and walks with a limp. He was last seen wearing a black hat, black jacket, white button-down shirt with a tie, light-colored pants and red shoes.
Just three months ago, PIX11’s Mary Murphy reported on sexual abuse in hospitals. While the investigation focused on abuse at the hands of medical staff, Monday’s incident is not believed to been committed by a hospital worker.
It is currently unknown if the man knew the victim, officials added.

Mother wracked with grief after 13-year-old fatally shot at sleepover
CENTRALIA, Ill. (KMOV.com) — All Jaianna Grant has left of her son is pictures.
Thirteen-year-old Jaden was shot May 4 after spending the night at a friend’s house, and now she’s left with questions about what she could have done differently.
Grant was was in Memphis when Jaden called to ask her if he could sleep over at a friends house, which she agreed to.
It was their last conversation.
“I said that was fine, and I really wish I wouldn’t have said yes,” she said. “I have a lot of guilt myself.”
Police were called to the 100 block of South Pine just after 5:45 a.m. and discovered the teen suffering from a gunshot wound to the head. He was taken to the hospital, but died two days later.
Grant got the call and sped from Memphis to the hospital, but never got to speak with her son again.
“It was just a sleepover,” she said.
Four teens who were present for the shooting were detained and later released.
On Monday, May 6, a 15-year-old boy was arrested in connection with the shooting and Grant said he pleaded guilty to involuntary manslaughter.
“I had to go to the first hearing before I could even go to my son’s funeral,” she said.
Investigators said their look into the incident is still in the early stages, and no progress updates have been provided as of May 14.
For Grant, there’s little closure she can hope for to assuage her grief. She’s left with loss and guilt, and the pain of imagining the life her son could have had.
“I don’t have him, he’s never going to grow,” she said, holding his picture. “This is all I’m going to be able to look at for the rest of my life.”

Woman pushed elderly man off bus, leading to his death, after he told her to be nice
LAS VEGAS (AP) — Security video recorded a woman shoving a 74-year-old man with a walker off a public transit bus in Las Vegas after he asked her to be nice to other passengers, and she’s facing a murder charge after the man died, according to court documents.
Serge Fournier hit his head on a sidewalk in the March 21 incident, police said, and the Clark County coroner ruled his death on April 23 a homicide resulting from his injuries.
Cadesha Michelle Bishop was arrested Monday on a murder warrant and was assigned a public defense attorney during her first court appearance on Tuesday. A Clark County public defender’s official did not immediately respond Thursday to messages.
A judge ordered Bishop, 25, held on $100,000 bail pending a preliminary hearing of evidence May 21.
A police report says Fournier was moving up the aisle of the Regional Transportation Commission bus when he asked a woman who had been cursing at other people to be nicer to passengers.

Bishop was accused of shoving Fournier out the door “with enough force that he never touched any of the steps” before hitting his head about 8 feet (2.4 meters) from the bus.
Court records show that Bishop was convicted twice, in 2014 and 2015, of misdemeanor domestic battery charges.

Alabama governor signs law that could punish doctors who perform abortions with life in prison
(CNN) — Alabama Gov. Kay Ivey on Wednesday signed into law a controversial abortion bill that could punish doctors who perform abortions with life in prison.
“Today, I signed into law the Alabama Human Life Protection Act, a bill that was approved by overwhelming majorities in both chambers of the Legislature,” said Ivey, a Republican, in a statement. “To the bill’s many supporters, this legislation stands as a powerful testament to Alabamians’ deeply held belief that every life is precious and that every life is a sacred gift from God.”
The Alabama Senate passed the bill 25-6 late Tuesday night. The law only allows exceptions “to avoid a serious health risk to the unborn child’s mother,” for ectopic pregnancy and if the “unborn child has a lethal anomaly.” Democrats re-introduced an amendment to exempt rape and incest victims, but the motion failed on an 11-21 vote.
Ivey noted in her statement that the new law may be unenforceable due to the Supreme Court’s Roe V. Wade decision that legalized abortion in all 50 states. But, the new law was passed with the aim of challenging that decision, Ivey said.
“No matter one’s personal view on abortion, we can all recognize that, at least for the short term, this bill may similarly be unenforceable,” Ivey wrote. “As citizens of this great country, we must always respect the authority of the U.S. Supreme Court even when we disagree with their decisions. Many Americans, myself included, disagreed when Roe v. Wade was handed down in 1973. The sponsors of this bill believe that it is time, once again, for the U.S. Supreme Court to revisit this important matter, and they believe this act may bring about the best opportunity for this to occur.”

Jail staff joked as dying woman cried out in pain
KANSAS CITY, Mo. – The children of a woman who died of a torn aorta at a jail in downtown Kansas City allege in a lawsuit that staff joked as the woman lay curled up on the floor, crying in pain.
The Kansas City Star reports that the lawsuit describes ReGina Thurman’s death two years ago at the Jackson County Detention Center as “horrible and preventable.” The suit says that the jail’s medical staff was dismissive when Thurman began experiencing severe chest pains while waiting to be processed on a probation violation. They gave her antacid tablets, while jailers accused her of overreacting.
The suit quotes the corrections department’s own report, which says one corrections officer said that Thurman “was suffering from jail-litus (sic).”
The county doesn’t comment on pending litigation.

Woman sues Kansas hospital after she says an employee contacted her accused rapist
ATCHISON, Kan. – An Atchison Hospital employee is accused of leaking a patient’s personal information to the woman’s suspected rapist, leading him to rape the victim a second time.
The hospital says patient confidentiality and protecting personal information is a top priority, and they blame a former employee whose actions they call “deeply disturbing.”
The victim was sexually assaulted in May 2017; she went to Atchison Hospital for an evaluation and to have a rape kit processed.
She told hospital staff who attacked her and was adamant they not disclose that information to anyone.
According to a lawsuit filed against Atchison Hospital and one of its former employees though, an X-ray technician at the hospital contacted the woman’s assailant to tell him the victim had accused him of sexual assault.
The woman said that led to her alleged attacker relentlessly harassing her through text messages, social media and phone calls, as well stalking her in public and her at her house, eventually raping her a second time. The lawsuit also says the hospital employee harassed and hounded her as well.
The suit blames Atchison Hospital for not securing patient medical information.
The hospital’s CEO wrote a letter to the patient, apologizing for any “concern or difficulty” the incident caused her.
Although the hospital fired the X-ray technician, the suit says Atchison Hospital gave her positive reviews so she could quickly get a new job at Saint Luke’s Cushing Hospital in Leavenworth. Saint Luke’s said it was unaware of the reason for the employee’s termination at Atchison before the lawsuit was filed, and they have since put her on administrative leave pending an internal investigation.
Atchison Hospital representatives said it’s reviewed the situation to see what could be done differently in the future.
The hospital said it “immediately implemented changes to internal controls including even stricter accessibility requirements to its Health Information Management Department. Patient confidentiality at Atchison Hospital and our ability to protect personal information is a top priority of ours.”
